Comments aren't XHTML Valid

I am attempting to validate my site with w3c validation service and it appears that the commenting system in wordpress is not XHTML Valid. Errors only appear when comments are enabled. To check the error for yourself you can go here: http://magickandme.co.uk/about/ and click the w3c validator button at the bottom. Hope someone can help. P.S. I have submitted this error to wordpress.org and have been told it is most likely a theme error

I cant seem to locate the code to remove, any hints/ideas?

Am I removing all the code or just the reference to aria-required because it made my comments box vanish. I am really new to this. Thank you
